본 구독 신청서를 제출함으로써 귀하("고객")는 OhMyWorks 클라우드 플랫폼 운영사인 AIROVER(에이아이로버)("제공자")와 본 서비스 이용약관("약관")에 구속되는 것에 동의합니다. 본 약관에 동의하지 않는 경우 아래에서 거부를 선택해야 하며, 이 경우 신청서는 제출되지 않습니다.
By submitting this subscription application, you ("Customer") agree to be bound by these Terms of Service ("Terms") with AIROVER (에이아이로버) ("Provider"), the operator of the OhMyWorks cloud platform. If you do not agree to these Terms, you must decline below and your application will not be submitted.
OhMyWorks는 본 신청서의 Plan & Billing(요금제 및 결제) 항목에서 선택한 요금제(BASIC / PRO / PREMIUM1)에 따라 클라우드 기반 제조실행시스템(MES), IoT Control, Robot Control 서비스를 구독 방식으로 제공합니다.
OhMyWorks provides cloud-based Manufacturing Execution System (MES), IoT Control, and Robot Control services on a subscription basis, as selected in the Plan & Billing section of this application (BASIC / PRO / PREMIUM1).
고객은 본 신청서에서 선택한 요금제 및 결제 주기(월간 또는 연간)에 해당하는 구독료를 등록한 결제수단(신용카드 또는 은행계좌)으로 지불하여야 합니다. 별도의 서면 합의가 없는 한, 관련 법령에서 달리 정하지 않는 이상 납부된 요금은 환불되지 않습니다.
Customer shall pay the subscription fee corresponding to the selected plan and billing cycle (monthly or annual) via the payment method registered in this application (credit card or bank account). Fees are non-refundable except as required by applicable law, unless otherwise agreed in writing.
구독 계약기간은 선택한 결제 주기(월간 또는 연간)를 따르며, 갱신 전 어느 일방이 해지를 통지하지 않는 한 동일 기간으로 자동 갱신됩니다. 어느 일방은 상대방이 서면 통지 후 30일 이내에 시정하지 않는 중대한 계약위반에 대하여 계약을 해지할 수 있습니다.
The subscription term follows the billing cycle selected (monthly or annual) and automatically renews for successive terms of the same duration unless either party provides notice of cancellation prior to renewal. Either party may terminate this agreement for the other party's material breach that remains uncured for 30 days after written notice.
제공자는 고객에게 구독 기간 동안 구독한 서비스에 접근하여 고객의 내부 업무 목적으로만 사용할 수 있는 비독점적, 양도불가능한 제한적 라이선스를 부여합니다. 고객은 서비스를 역설계, 재판매, 재라이선스하거나 경쟁 제품 개발에 사용할 수 없습니다.
Provider grants Customer a non-exclusive, non-transferable, limited license to access and use the subscribed services during the subscription term, solely for Customer's internal business operations. Customer shall not reverse-engineer, resell, sublicense, or use the service to build a competing product.
고객이 서비스에 입력한 모든 데이터("고객 데이터")에 대한 소유권은 고객에게 있습니다. 제공자는 고객 데이터를 서비스 제공 및 개선 목적으로만 사용하며, 서비스 운영에 필요한 경우(예: Supabase/Google 등 인프라 제공업체) 또는 법령상 요구되는 경우를 제외하고 제3자에게 제공하지 않습니다.
Customer retains ownership of all data it submits to the service ("Customer Data"). Provider will use Customer Data solely to provide and improve the service and will not disclose it to third parties except as required to operate the service (e.g., Supabase/Google infrastructure providers) or as required by law.
OhMyWorks 서비스를 구성하는 모든 소프트웨어, 소스코드, 디자인, 상표 및 문서에 대한 권리는 제공자에게 귀속됩니다. 본 약관의 어떠한 내용도 제5조에서 부여한 제한적 라이선스 외에 고객에게 지식재산권을 이전하지 않습니다.
All software, source code, designs, trademarks, and documentation constituting the OhMyWorks service are and remain the exclusive property of Provider. Nothing in these Terms transfers any intellectual property rights to Customer other than the limited license granted in Section 5.
각 당사자는 본 계약과 관련하여 상대방으로부터 공개받은 비공개 정보를 비밀로 유지하고, 이를 본 계약상 의무 이행 목적으로만 사용하는 것에 동의합니다.
Each party agrees to keep confidential any non-public information disclosed by the other party in connection with this agreement, and to use such information solely to perform its obligations hereunder.
제공자는 서비스 가용성을 유지하기 위해 상업적으로 합리적인 노력을 기울이나, 서비스의 중단 없는 운영이나 오류 없는 운영을 보증하지 않습니다. 서비스는 "있는 그대로(AS IS)" 및 "제공 가능한 상태로(AS AVAILABLE)" 제공되며, 상품성, 특정 목적 적합성, 비침해에 대한 명시적·묵시적 보증을 포함한 어떠한 보증도 하지 않습니다.
Provider will use commercially reasonable efforts to maintain service availability but does not guarantee uninterrupted or error-free operation. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
관련 법령이 허용하는 최대 범위 내에서, 본 계약과 관련하여 발생하는 제공자의 총 책임은 청구 발생 시점 이전 12개월간 고객이 납부한 총 구독료를 초과하지 않습니다. 제공자는 간접손해, 부수적 손해, 특별손해 또는 결과적 손해에 대하여 책임을 지지 않습니다.
To the maximum extent permitted by law, Provider's total liability arising out of or related to this agreement shall not exceed the total subscription fees paid by Customer in the 12 months preceding the claim. Provider shall not be liable for indirect, incidental, special, or consequential damages.
고객은 고객의 서비스 오용 또는 본 약관 위반으로 인하여 발생하는 모든 청구, 손해 또는 책임으로부터 제공자를 면책하고 이를 보상하는 것에 동의합니다.
Customer agrees to indemnify and hold Provider harmless from any claims, damages, or liabilities arising from Customer's misuse of the service or violation of these Terms.
천재지변, 전쟁, 인터넷 또는 인프라 장애, 정부의 조치 등 당사자의 합리적인 통제범위를 벗어난 사유로 인한 이행의 불능 또는 지연에 대하여 어느 당사자도 책임을 지지 않습니다.
Neither party shall be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including natural disasters, war, internet or infrastructure outages, or governmental action.
고객은 OhMyWorks 사용자 인터페이스가 모든 용어를 "영어(한글)" 이중언어 병기 방식으로 표시하는 것이 의도된 디자인 표준임을 인지합니다. 고객은 이 표기 방식에 동의하며, 사용상 불편을 이유로 이중언어 표기 방식의 변경을 요구하지 않는 것에 동의합니다.
Customer acknowledges that the OhMyWorks user interface displays all terms in a bilingual "English(Korean)" format as a deliberate design standard. Customer agrees to this format and waives any request for modification of this bilingual display convention on grounds of usability inconvenience.
IoT Control 및 Robot Control 메뉴는 각각 스마트팜 센서/릴레이 제어 및 ROS2 기반 로봇 플릿 관리를 시범 구현한 실증모델입니다. 제공자는 현재 실증 범위에 포함되지 않는 고객이 요청하는 특정 하드웨어나 제품에 대한 지원을 보증하지 않습니다. 이러한 요청을 지원하기 위한 추가 개발은 고객과 제공자 간 별도의 서면 계약 및 비용 협의를 필요로 합니다.
The IoT Control and Robot Control menus are pilot implementations of demonstration models (smart farm sensor/relay control and ROS2-based robot fleet management, respectively). Provider does not guarantee support for specific customer-requested hardware or products not covered by the current pilot scope. Any additional development to support such requests requires a separate written contract and cost agreement negotiated between Customer and Provider.
OhMyWorks가 부가기능으로 상용 AI서비스와의 연동 서비스를 제공하는 경우, 고객은 해당 상용 AI서비스에 직접 구독 신청하고 자신의 API 키를 등록하여 이 기능을 이용하여야 합니다. 해당 상용 AI서비스 제공업체가 부과하는 모든 비용은 고객이 해당 제공업체에 직접 지불하여야 하며, 제공자는 이러한 제3자 비용이나 서비스 약관에 대하여 책임을지지 않습니다.
If OhMyWorks offers integration with third-party commercial AI services as an additional feature, Customer must directly subscribe to such third-party AI service and register its own API key to use the feature. All fees charged by the third-party AI service provider shall be paid directly by Customer to that provider, and Provider shall have no responsibility for such third-party fees or service terms.
본 계약은 대한민국 법률에 따라 규율됩니다. 본 계약과 관련하여 발생하는 모든 법적 분쟁은 대한민국 소재 AIROVER(에이아이로버)의 등록 주소지를 관할하는 법원을 전속 관할 법원으로 합니다.
This agreement shall be governed by the laws of the Republic of Korea. Any legal dispute arising from or in connection with this agreement shall be subject to the exclusive jurisdiction of the court having jurisdiction over the registered address of AIROVER (에이아이로버) in the Republic of Korea.
제공자는 본 약관을 수시로 변경할 수 있습니다. 중요한 변경사항은 서비스 내 공지 또는 이메일을 통해 고객에게 통지되며, 통지 이후 서비스를 계속 이용하는 경우 변경된 약관에 동의한 것으로 간주됩니다.
Provider may amend these Terms from time to time. Material changes will be notified to Customer through the service or by email, and continued use of the service after such notice constitutes acceptance of the amended Terms.
본 약관은 본 구독 신청서에 제출된 정보와 함께 본 약관의 대상에 관하여 고객과 제공자 간의 완전한 합의를 구성하며, 이전의 구두 또는 서면 합의를 대체합니다.
These Terms, together with the information submitted in this subscription application, constitute the entire agreement between Customer and Provider regarding the subject matter herein, superseding any prior oral or written understandings.
